Circulation and Distribution

The Circulation and Distribution Section of King & Ballow, in its national practice of circulation and distribution law, has represented more than 300 daily and weekly newspapers.  Our attorneys assist publishers and circulation departments with the broad range of legal issues tehy face, including independent contractor status, the First Amendment, and disputes with the Audit Bureau of Circulations (ABC).  Typical circulation issues involve challenges to the independent contractor status of distributors, governmental interference with a publisher’s First Amendment right to distribute its product including news-rack restrictions and littering ordinances, and disputes with ABC regarding the extent and nature of newspaper circulation.  Our attorneys design and implement distribution systems for clients, prepare and implement contracts, and provide consultation and litigation services.  King & Ballow attorneys also provide legal service to associations of newspaper circulation managers and participate as speakers and instructors at programs offered by media trade associations across the country.
