1st Preference Petitions:
Intracompany Transfer of Managers or Executives may be admitted to the U.S.
for permanent residency. They must work for multinational companies
with offices in the U.S.
and abroad.
Extraordinary Ability Aliens in the Arts, Entertainment, Business,
Sciences, or Sports are for those who have risen to the very top of the
field of endeavor. They must demonstrate international recognition in
the field.
Outstanding Researchers or Professors in higher education or private
research facilities may be sponsored by the institution or company for
permanent residency. They must have experience in the position and
demonstrate recognition in the field.
2nd Preference Petitions:
Exceptional Ability Aliens are those who have shown exceptional ability in
the field of endeavor.
Advanced Degree Professionals may be admitted in a Master's level position
or above. A labor certification is required, which is a test of the U.S. labor
market for available U.S.
workers. Some persons may qualify for a waiver of the labor
certification for doing work in the national interest; a National Interest
Waiver.
3rd Preference Petitions:
Professionals with Bachelor's Degrees and Skilled Workers may be admitted
through the labor certification process and when sponsored by an employer.
Unskilled Workers may be admitted after a labor certification.
However, the wait for a visa is several years.
Other:
Religious Workers may obtain permanent residency after two years of
religious employment in the U.S.
Other Special Immigrants include Battered Spouses and Asylees and Refugees.
5th Preference:
Employment Creation Investors -- Actively invest $1 million or $.5 million
(in a designated high-unemployment area) USD in a U.S. business and create 10 jobs. The employment creation investor is
granted a 2-year term of conditional residency. After 2 years, a new
petition is required to remove the conditions on permanent residency and in
order to demonstrate that the investor has invested the entire required
amount, has maintained the investment, and has employed at least ten people
on a full time basis.
Refugees are admitted to the U.S. when it has been
determined they have been subjected to persecution in their home
countries. They enter the U.S. in refugee status and may
apply for permanent residency.
Asylees are already in the U.S.
and apply to INS based on a claim of past persecution or fear of future
persecution in their home countries.
